These terms are the agreement between you and us for using Mailfois. They're written to be read. If anything's unclear, email [email protected].
Who we are
Mailfois is a trading name of WealthR Ltd, a company registered in Scotland (company number SC900929), whose registered office is at 5 South Charlotte Street, Edinburgh, EH2 4AN ("we", "us"). When you sign up, you're agreeing to these terms with WealthR Ltd. If you sign up for an organisation, you're confirming you can agree to them on its behalf, and "you" means that organisation.
What Mailfois is
Mailfois is a workspace for planning, checking, approving and keeping email campaigns. It works alongside the email service provider (ESP) you already use. It doesn't send your marketing emails: you still send those from your ESP, and you're responsible for them, including following the email marketing laws that apply to you and your recipients. Our guides explain the main ones, but they're general information, not legal advice.
The free tools on mailfois.com can be used without an account. These terms apply to them too, as far as they're relevant.
Your account
- You need to be at least 16 to use Mailfois.
- Keep your login details safe. You're responsible for what happens in your account and your workspaces.
- Workspace owners and admins decide who has access, what they can see and who can approve. That includes guest approvers you invite by private link. We send each review link to exactly the email address you enter, so check it before you send. Anyone with the link can see that review, so if one goes to the wrong person, switch it off straight away from the review.
- Give us accurate details, and keep your billing details up to date.
Your content is yours
Everything you put into Mailfois stays yours: plans, emails, copy, translations, brand kits, documents and comments. You give us permission to store it, process it and show it to the people you share it with, only so we can run the service for you. We don't sell it, and we don't use it to train AI models.
You're responsible for having the right to use what you upload, and for the personal data you add, such as approvers' names and email addresses. For that data you're the controller and we act on your instructions as your processor. Our privacy policy explains how we handle it, and our Data Processing Agreement forms part of these terms.
Using Mailfois fairly
Don't use Mailfois to break the law, to plan or send spam, to upload anything harmful or that you don't have the rights to, to try to get into other people's accounts or data, or to disrupt the service. Don't resell access without our agreement. If you do any of these, we may suspend or close your account. Where we can, we'll tell you first and give you a chance to put it right.
Plans, billing and trials
- The Free plan is free. Paid plans (Pro, Team and Agency) are billed monthly in advance, in pounds, US dollars, Canadian dollars or Australian dollars, through our payment provider, Stripe.
- Team and Agency plans are priced per seat, and Agency plans include a number of client workspaces with a monthly charge for each one beyond that. Agency bills update automatically when you add or remove client workspaces.
- Prices don't include taxes. Where we're required to charge VAT, sales tax or GST, we'll add it at checkout.
- Free trials last for the period shown when you start them. If you don't cancel before the trial ends, your plan starts and you're charged.
- You can cancel at any time from the Billing page. Your plan stays active until the end of the period you've paid for. We don't refund part-months, except where the law says we must.
- If we change our prices, we'll give you at least 30 days' notice by email before the new price applies to you. Founder prices stay as long as you keep your plan.
Availability and changes
We work to keep Mailfois running and your data safe, but we can't promise it will always be available or error-free. We may improve, change or remove features. If we remove something significant you're paying for, we'll tell you in advance and, if it makes Mailfois worse for you, you can cancel and we'll refund any unused prepaid time.
If Mailfois closes. If we ever decide to stop running Mailfois, we'll email every workspace owner at least 90 days before it closes. Until then everything keeps working, and you can export all your data as usual. We'll refund any time you've paid for beyond the closing date. If something outside our control forces us to close sooner, such as a court order or the failure of a provider we can't replace in time, we'll give as much notice as we can and keep your data available to export for as long as we're able.
Ending your account
You can stop using Mailfois at any time. You can export your data from Settings, and delete workspaces or your whole account yourself in Settings → Data & privacy. Deleting your account cancels any paid plan on workspaces only you are in. Work you've shared in a team's workspace stays with that team, without your name on it. We'll delete your data within 30 days of your account closing, apart from what we have to keep by law (for example, billing records). Copies in backups expire on their normal cycle.
We can close your account if you seriously or repeatedly break these terms, or if we stop running Mailfois. If we stop running it, we'll give you at least 60 days' notice so you can export your data, and refund any unused prepaid time.
Our liability
Nothing in these terms limits liability that can't be limited by law, such as for death or personal injury caused by negligence, or for fraud. Apart from that:
- we're not responsible for indirect or consequential losses, or for lost profits, revenue, data or goodwill;
- we're not responsible for emails you send from your ESP, including whether they meet the law where your recipients are; and
- our total liability to you in any 12 months is limited to the greater of what you paid us in those 12 months and £100.
If you're using Mailfois as a consumer, rather than for a business, you also have legal rights these terms don't affect.
Transferring this agreement
We may transfer this agreement, and your account and data, to another company that takes over running Mailfois, including a company we set up for that purpose. If we do, we'll tell you, your rights under these terms won't be reduced, and the new company will be responsible for your data. You can't transfer your account to someone else without our agreement.
Changes to these terms
If we change these terms in a way that matters, we'll email account owners at least 30 days before the change takes effect. If you don't agree, you can cancel before then.
Law and disputes
These terms are governed by the law of Scotland. If there's a dispute, please contact us first and we'll try to sort it out. If we can't, the Scottish courts will decide it. If you're a consumer living elsewhere in the UK, you can also bring a claim in your local courts.
